It isn't bofa's fault that you didn't log in earlier & schedule your payments due today. I too am annoyed that I can't log in, but it isn't BofA's fault that you didn't have the forsight to either pay your bills early, or at least schedule their payment. Also, many places (phone companies, etc.) offer online payment services directly from their own website too. I do that when I realize I "forgot" to make a payment, that way the biller knows I made the effort to pay the bill on time.
Technology is a convenience, not a right. Technology is not fail proof, so honestly your "lawsuit" should be dismissed.
